1. Who we are and how to reach us
Berenice 2 AM Corp d/b/a Bobboi Natural Gelato 8008 Girard Avenue, La Jolla, CA 92037 Phone: (858) 255-8693 Privacy requests and questions: submit through our contact form at https://www.bobboi.com/contact-us-bobboi
We are the "business" responsible for the personal information described in this Policy.
2. Personal information we collect
In the twelve months before the date of this Policy, we have collected the following categories of personal information, using the category names set out in the CCPA:
Identifiers — name, email address, postal address, phone number, IP address, and online or device identifiers.
Customer records information (Cal. Civ. Code §1798.80(e)) — name, contact details, and payment card information collected when you place an order. Payment card numbers are collected and processed by our payment processor; we do not store full card numbers on our systems.
Commercial information — records of products you have purchased or considered, order history, and gift card purchases and balances (and, if we introduce a loyalty program you choose to join, your activity in it).
Internet or other electronic network activity information — browser type and language, referring and exit pages, pages viewed, links clicked, time spent on pages, and similar interaction data collected through cookies and comparable technologies.
Geolocation data — approximate location inferred from your IP address. We do not collect precise geolocation from your device.
Audio, electronic, visual or similar information — the content of messages you send us through the contact form, by email, or by phone.
Inferences — preferences and characteristics we infer from the above, for example which gelato flavors or product categories you are likely to be interested in.
We do not knowingly collect sensitive personal information as that term is defined by the CPRA, and we do not use or disclose sensitive personal information for purposes that would require us to offer a right to limit its use.
3. Where the information comes from
We collect personal information from these sources:
Directly from you — when you place an order, buy a gift card, subscribe to our newsletter, complete the contact form, sign up for a loyalty program if we offer one, apply for a job, or otherwise communicate with us.
Automatically from your device — through cookies, pixels, tags, software development kits, and server logs when you visit the Site.
From service providers and partners — our website platform, payment processor, email and marketing platforms, and analytics and advertising providers.
4. Why we use your information
We use personal information for the following business and commercial purposes:
To provide the Site and fulfil your orders, including processing payments, arranging delivery or pickup, and issuing and redeeming gift cards.
To respond to your questions, requests, reviews, and customer service enquiries.
To operate and administer any loyalty program we may offer and that you choose to join.
To send you marketing and promotional messages where you have asked to receive them, and to let you opt out of them at any time.
To measure and improve the Site, our products, and our marketing — including understanding which pages and products are popular.
To advertise, including showing you Bobboi advertising on other websites and platforms and measuring whether that advertising works.
To maintain the security and integrity of the Site, detect and prevent fraud, and debug and repair errors.
To comply with legal obligations, respond to lawful requests, and establish, exercise, or defend legal claims.
We do not use your personal information for materially different, unrelated, or incompatible purposes without providing you notice.
5. Disclosure, "sale," and "sharing" of personal information
We do not sell personal information for money.
However, the CCPA/CPRA defines "sale" and "sharing" broadly. When advertising and analytics technologies such as pixels, tags, and cookies operate on the Site, the information they transmit to the companies that provide them may be treated as a "sale" or as "sharing for cross-context behavioral advertising" under California law. So that you can make an informed choice, we treat our use of advertising and analytics technologies as "sharing," and we give you the right to opt out of it.
Categories of personal information we may disclose, sell, or share, and to whom:
Identifiers, internet or electronic network activity information, geolocation data, commercial information, and inferences may be disclosed to, or shared with, advertising networks and social media platforms and analytics providers, for cross-context behavioral advertising and measurement.
Identifiers, customer records information, and commercial information may be disclosed to service providers and contractors — including our website hosting platform (Wix.com Ltd.), our payment processor, our delivery and fulfilment providers, and our email and marketing platforms — so that they can perform services for us. These providers are contractually restricted from using your information for their own purposes.
Any category may be disclosed to professional advisors (such as lawyers and accountants), to a buyer or successor in the event of a merger, acquisition, or sale of assets, and to law enforcement, regulators, or courts where we are legally required to do so or where necessary to protect our rights or the safety of others.
We do not sell or share the personal information of consumers we know to be under 16 years of age.
To opt out of the sale and sharing of your personal information, use the "Do Not Sell or Share My Personal Information" link in the footer of every page of the Site, or submit a request through our contact form.
6. Cookies and similar technologies
The Site uses cookies and similar technologies — including pixels, tags, and local storage — for the following purposes:
Strictly necessary — required for the Site to function, for example to keep items in your cart, keep you signed in, and maintain security. These cannot be switched off.
Functional — remember your preferences and settings.
Analytics — help us understand how visitors use the Site so we can improve it.
Advertising — used to deliver and measure advertising, including advertising shown to you on other sites and platforms.
When you first visit the Site you are shown a cookie consent banner allowing you to accept or decline non-essential categories. You can change your choice at any time using the cookie preferences control on the Site. You can also configure your browser to refuse or delete cookies, though parts of the Site may not work correctly if you do.
7. Global Privacy Control and Do Not Track
We recognize and honor the Global Privacy Control ("GPC") signal. If you transmit a GPC signal from your browser or a browser extension, we will treat it as a valid request to opt out of the sale and sharing of the personal information associated with that browser, as required by the CCPA/CPRA. Because a GPC signal is tied to a specific browser and device, it will not apply to other browsers or devices you use, and it does not identify you to us for the purpose of opting out any account-level information unless you are signed in.
There is no common industry standard for responding to "Do Not Track" browser signals. Apart from GPC, described above, we do not currently respond to Do Not Track signals.
8. Your California privacy rights
If you are a California resident, you have the following rights:
Right to know — to request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting or disclosing it, and the categories of third parties to whom we disclosed it.
Right to delete — to request that we delete personal information we collected from you, subject to the exceptions permitted by law.
Right to correct — to request that we correct inaccurate personal information we hold about you.
Right to opt out of sale and sharing — to direct us not to sell or share your personal information, as described in section 5.
Right to limit use of sensitive personal information — we do not use or disclose sensitive personal information in a way that triggers this right.
Right to non-discrimination — we will not deny you goods or services, charge you a different price, or provide you a different level or quality of service because you exercised any of these rights.
Right to no retaliation — if you are an employee or applicant, we will not retaliate against you for exercising these rights.
9. How to exercise your rights
You can submit a request in either of these ways:
Through the contact form at https://www.bobboi.com/contact-us-bobboi
By calling us at (858) 255-8693
To protect your information, we will ask you for enough detail to verify that you are the person the information relates to — typically the email address, phone number, or order details associated with your record. For requests to know specific pieces of personal information, we apply a higher standard of verification. We will not use information you provide for verification for any other purpose.
An authorized agent may submit a request on your behalf. We will ask the agent for written permission signed by you, and we may ask you to verify your own identity directly with us.
We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we need more time we will tell you why, and we may extend by a further 45 days. There is no charge for responding to your request unless it is manifestly unfounded or excessive, in which case we will tell you before proceeding.
10. Shine the Light
Separately from the CCPA/CPRA, California Civil Code §1798.83 allows California residents to request information about personal information we disclosed to third parties for their own direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes. You may submit a Shine the Light request through our contact form.
11. Loyalty or rewards program (if offered)
We do not currently operate a loyalty or rewards program. We may introduce one in the future. If and when we do, and it offers you benefits — such as discounts, rewards, or promotional offers — in exchange for personal information, that would be a "financial incentive" under the CCPA, and the following would apply.
Participation would be entirely voluntary. You could join at any time by signing up, and withdraw at any time by contacting us through our contact form, after which you would stop receiving program benefits.
Before you enroll, we will present the program's specific terms — including the categories of personal information involved, the benefits offered, and how the value of those benefits relates to the value of your information — in a Notice of Financial Incentive, as required by the CCPA. We will update this section with those details at that time. We do not otherwise place a monetary value on your personal information.
12. How long we keep your information
We keep personal information for as long as needed for the purpose it was collected for, and then for as long as we are required to keep it by law.
In practice: order and transaction records are kept for seven years to meet tax and accounting requirements; gift card records are kept for as long as a balance remains and for seven years afterward; contact form and customer service messages are kept for two years; marketing subscriber records are kept until you unsubscribe and for a short period afterward to honor your opt-out; and website analytics data is kept in identifiable form for no more than twenty-six months.
13. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or of electronic storage is completely secure, and we cannot guarantee absolute security.
14. Children's privacy
The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us through our contact form and we will delete it.
15. Third-party links
The Site contains links to other websites, including our social media pages. We are not responsible for the privacy practices of those sites. We encourage you to read the privacy policy of every website you visit.
16. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide additional notice on the Site. We review this Policy at least once every twelve months, as required by California law.
17. Contact us
If you have questions about this Privacy Policy or how we handle personal information, contact us through the contact form at https://www.bobboi.com/contact-us-bobboi or call (858) 255-8693.
